BIRTHFIT COACH COURSE ENROLLMENT AGREEMENT

This Agreement is entered into between BIRTHFIT ("Company") and the individual enrolling in the BIRTHFIT Coach Course ("Participant").

By enrolling in the BIRTHFIT Coach Course, Participant agrees to the following terms and conditions:

1. COURSE INVESTMENT & PAYMENT

1.1 Course investment is $1,950 USD (unless discount code used). Participant has selected their payment option (pay in full or payment plan) at time of enrollment.

1.2 All sales are final. No refunds will be issued for any reason after enrollment.

2. COURSE ACCESS & ATTENDANCE REQUIREMENTS

2.1 Live training calls will be held in February and March 2026. Additional bonus calls may be announced via email.

2.2 Participant commits to attending live calls when possible and watching recordings when unable to attend live.

2.3 Participant agrees to honor their time and the instructor's time by being present, engaged, and prepared for all sessions.

2.4 Access to course recordings will be available until April 30, 2026. After this date, access will expire.

3. CERTIFICATION REQUIREMENTS

3.1 To become a certified BIRTHFIT Coach or Practitioner, Participant must:
a) Attend at least four (4) live training calls, and
b) Pass the exit quiz with a passing score

3.2 Upon successful completion of requirements in 3.1, Participant will receive their BIRTHFIT Coach or Practitioner certification.

4. POST-CERTIFICATION RIGHTS & RESTRICTIONS

4.1 Certified coaches may use the official BIRTHFIT Coach or Practitioner logo in their marketing materials.

4.2 Participant must obtain their own liability insurance to practice as a BIRTHFIT Coach or Practitioner.

4.3 Certified coaches and practitioners work independently and are not employees, agents, or representatives of BIRTHFIT.

5. INTELLECTUAL PROPERTY & CURRICULUM USE

5.1 All course materials, curriculum, content, resources, and methodologies are the exclusive intellectual property of BIRTHFIT and are protected by copyright and trademark laws.

5.2 Participant may not reproduce, distribute, modify, or create derivative works from any BIRTHFIT materials without express written permission.

5.3 Once certified and insured, Participant may teach BIRTHFIT curriculum in-person in their local communities only. Virtual teaching of BIRTHFIT curriculum is not permitted.

5.4 Classes may only be labeled "BIRTHFIT" if they follow the official BIRTHFIT curriculum. Participant may not apply the BIRTHFIT name or branding to other programs, classes, or content not part of the official curriculum.

5.5 Participant agrees to uphold the integrity of BIRTHFIT's philosophy, seven foundational pillars, and evidence-based holistic approaches in all work associated with the BIRTHFIT name.

6. CONFIDENTIALITY

6.1 Participant agrees to maintain confidentiality of all proprietary information, course content, and any client information encountered through course examples or community discussions.

6.2 Participant will not share, distribute, or sell course materials, recordings, or workbooks to non-enrolled individuals.

7. CODE OF CONDUCT & PROFESSIONAL ETHICS

7.1 Participant agrees to conduct themselves professionally and ethically when representing BIRTHFIT training.

7.2 Participant will provide services within their scope of practice and refer clients to appropriate healthcare providers when necessary.

7.3 Participant will maintain professional boundaries with clients and uphold the highest standards of care.

7.4 Any violation of professional ethics or misuse of the BIRTHFIT name may result in immediate termination of certification and directory listing.

8. MARKETING & PROMOTIONAL RIGHTS

8.1 BIRTHFIT reserves the right to use Participant's name, likeness, testimonials, and success stories for marketing and promotional purposes.

8.2 Participant grants BIRTHFIT permission to share their professional journey and client results (with appropriate privacy considerations) in promotional materials.

9. COMMUNICATION EXPECTATIONS

9.1 All official communication will occur via email and/or the BIRTHFIT Community chat forum.

9.2 Participant agrees to maintain a professional email address and check communications regularly.

9.3 Participant is expected to engage respectfully in all community interactions and contribute positively to the learning environment.

10. TERMINATION

10.1 Either party may terminate this agreement at any time.

10.2 If Participant terminates enrollment, no refund will be issued per section 1.2.

10.3 If BIRTHFIT terminates this agreement due to Participant's breach of terms, no refund will be issued and certification privileges will be revoked.

10.4 Upon termination, Participant must immediately cease use of all BIRTHFIT branding, logos, and curriculum materials. Participant will lose access to course materials.

11. LIABILITY & INDEMNIFICATION

11.1 Participant acknowledges that BIRTHFIT is an educational organization and that they are solely responsible for their own business operations, client services, and liability coverage.

11.2 Participant agrees to indemnify and hold harmless BIRTHFIT, its founder, employees, and affiliates from any claims, damages, or liabilities arising from Participant's coaching services or business operations.

12. GENERAL PROVISIONS

12.1 This Agreement constitutes the entire agreement between the parties and supersedes all prior communications or agreements.

12.2 This Agreement shall be governed by the laws of the state where BIRTHFIT is incorporated.

12.3 If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full effect.

12.4 BIRTHFIT reserves the right to modify course schedule, content, or policies with reasonable notice to Participant.

ACKNOWLEDGMENT & ACCEPTANCE

By enrolling in the BIRTHFIT Coach Course, I acknowledge that I have read, understood, and agree to be bound by all terms and conditions outlined in this Agreement.

I understand that my enrollment serves as my electronic signature and acceptance of these terms.
